Welcome to Noveris Signature (“Noveris Signature,” “we,” “our,” or “us”). These Terms of Service govern the use of our website and the mobile notary, loan signing, and remote online notarization services we provide.
By requesting, scheduling, or using our services, you agree to these Terms of Service. If you are scheduling an appointment on behalf of a lender, title company, attorney, signing service, or another organization, you represent that you are authorized to make the request on that organization's behalf.
If you do not agree to these terms, please do not book or use our services.
Noveris Signature provides mobile notary services, loan signing services, and remote online notarization where available and legally authorized. Our services may include mortgage closings, refinances, home equity transactions, real estate document signings, and other authorized notarial acts.
Service availability depends on location, scheduling, document requirements, notary qualifications, applicable law, and the nature of the requested assignment.
We reserve the right to decline assignments that fall outside our service capabilities, cannot be performed lawfully, or present unreasonable safety, security, or operational concerns.
Our notaries are trained to provide professional, courteous, dependable, and accurate service. We strive to make every appointment as smooth and convenient as possible while protecting the integrity of the notarization and the confidentiality of the documents entrusted to us.
Our service standards include:
An anticipated early arrival is a service goal, not a guarantee. Traffic, weather, access restrictions, emergencies, and other circumstances outside our reasonable control may affect arrival times.
The safety and security of our notaries are a priority at Noveris Signature.
Our notaries are not required to enter or remain in any location they reasonably believe presents a safety risk. We reserve the right to refuse, suspend, relocate, or terminate an appointment when circumstances indicate that the assignment may be unsafe.
Examples of circumstances that may warrant refusal or termination include:
Our notaries may leave an appointment immediately if they believe their safety is at risk. Where practical and safe, the client or scheduling party will be notified.
We will not require a notary to continue an assignment merely because a client has paid a fee or because a closing deadline is approaching.
Consistent with our published safety policy, Noveris Signature does not conduct general notary appointments inside private residences. Residential appointments may be accepted when they involve a scheduled real estate closing or another qualifying assignment arranged through an affiliated bank, title company, lender, or signing company.
When possible, such appointments may be conducted at a mutually agreed-upon safe location. Clients must provide accurate information about the appointment, its location, and the documents requiring notarization before the assignment is confirmed.
We reserve the right to request a change of location or decline an assignment when the proposed setting does not meet our safety requirements.
For the safety of our notaries and clients, we may require that pets be secured in a separate, enclosed area away from the signing location before the appointment begins.
Clients are responsible for ensuring that animals are appropriately restrained or secured. If a pet cannot be safely managed, the notary may pause the appointment, request that the appointment be relocated, or discontinue the assignment.
Any resulting cancellation or rescheduling fee will be determined in accordance with the applicable booking terms and disclosed fee schedule.
Clients and individuals participating in a signing appointment are expected to:
Clients must not ask our notaries to backdate documents, notarize signatures improperly, bypass identification requirements, provide legal advice, or perform any act prohibited by law.
Failure to meet these responsibilities may result in delays, rescheduling, refusal of service, or additional fees where permitted and disclosed.
Appointments are scheduled based on availability, assignment requirements, location, and the information supplied at booking.
Although we strive to arrive 10–15 minutes before the scheduled appointment, clients should plan to be available at the confirmed appointment time and allow sufficient time for the signing process.
Clients should notify us as soon as possible if they anticipate being late or need to change an appointment.
If a notary anticipates a significant delay, we will make reasonable efforts to communicate the delay and, when practical, discuss alternative arrangements.
Appointment times are estimates unless expressly confirmed otherwise in writing. We are not responsible for delays caused by circumstances outside our reasonable control, including severe weather, traffic incidents, road closures, emergencies, or delays caused by clients or third parties.
Fees depend on the type of service, travel distance, document volume, printing and scanning requirements, appointment timing, witnesses, and other assignment-specific requirements.
Applicable fees will be disclosed and agreed upon before services are provided. Certain assignments may be arranged and paid for by a lender, title company, signing service, or other business client under a separate agreement.
Unless otherwise agreed in writing, clients are responsible for the fees associated with services they request.
Additional charges may apply when disclosed and agreed upon in advance, including charges for:
All fees remain subject to applicable law, including any statutory limits or restrictions on notarial charges.
Once a notary has been dispatched for a confirmed appointment, the client or responsible booking party is expected to honor the appointment or provide timely cancellation notice in accordance with the applicable cancellation policy.
If our notary arrives at the confirmed location and is denied access, the client refuses to proceed with the signing, or the appointment cannot be completed because the client or required signer is unavailable or unprepared, the applicable agreed-upon trip, cancellation, or appointment fee may still be charged.
This may include circumstances in which:
Any charge will be based on the agreed booking terms and the services or travel provided, and will be subject to applicable law. We will not charge a fee that is prohibited by law.
Where an appointment cannot proceed because of a concern attributable to Noveris Signature, the fee adjustment provisions in Section 10 will apply as appropriate.
We understand that circumstances can change. Clients should contact us as soon as possible if they need to cancel or reschedule an appointment.
Cancellation charges, if any, will depend on the assignment terms, the timing of the cancellation, whether a notary has already been dispatched, and any costs or services already incurred.
For assignments arranged through a lender, title company, signing service, or other business client, the cancellation provisions in the applicable agreement may control.
We reserve the right to cancel or reschedule appointments because of safety concerns, illness, emergencies, severe weather, operational disruptions, incomplete information, or other legitimate circumstances.
Where practical, we will notify the client or booking party and attempt to arrange an alternative appointment.
We are committed to providing accurate and professional signing services. We recognize that punctuality and correct document execution are important to clients, lenders, title companies, and other transaction participants.
If a Noveris Signature notary arrives late due to circumstances within our reasonable control, makes an error attributable to our service that delays or prevents completion, or causes an assignment to be cancelled because of a service-related error, we will review the circumstances and take appropriate corrective action.
Depending on the nature and impact of the issue, this may include:
Any adjustment will be proportionate to the circumstances and consistent with the applicable client agreement and law.
We will not charge a client for a service that was not performed when the failure to perform resulted from a material error attributable to Noveris Signature, except where a separate, lawful, previously disclosed charge applies to services or expenses already incurred.
This policy does not automatically apply to delays, document defects, cancellations, or incomplete signings caused by clients, lenders, title companies, document preparation errors, unavailable third parties, changes in instructions, or circumstances beyond our reasonable control.
Clients and business partners should notify us promptly of any suspected service error so we can investigate and determine the appropriate resolution.
Our notaries perform authorized notarial acts in accordance with applicable law. They are not attorneys merely by virtue of providing notary services and do not provide legal advice, tax advice, financial advice, or opinions concerning the legal effect of documents.
Our notaries may identify document fields, explain the signing process, and follow authorized procedural instructions. They cannot advise clients whether to sign a document, interpret legal provisions, recommend changes to a contract, or determine whether a transaction is in a client's best interests.
A notary may refuse to perform a notarization if required identification is unavailable, the signer does not appear willing or competent to proceed, fraud or coercion is suspected, the requested act is unlawful, or other legally recognized grounds for refusal exist.
Payment of a service fee does not obligate a notary to perform an act that would violate the law or the notary's professional obligations.
Loan signing agents facilitate the execution of documents according to the instructions supplied by the authorized lender, title company, signing service, or other responsible party.
Noveris Signature does not originate loans, approve mortgage applications, guarantee loan funding, determine underwriting decisions, or guarantee that a transaction will close.
Clients and responsible business parties are responsible for ensuring that documents are complete, accurate, current, and suitable for their intended transaction before they are provided for signing.
Although we take reasonable care to follow instructions and check documents for required signatures, initials, dates, and notarial certificates within the scope of the assignment, we cannot guarantee that a lender, title company, recording office, court, or other recipient will accept a document or approve a transaction.
If a document contains an error, omission, inconsistent instruction, or other issue requiring clarification, we may pause the assignment and contact the authorized party for instructions.
We are not responsible for defects in documents prepared or supplied by third parties, or for transaction delays caused by their instructions, decisions, or processing procedures, except to the extent responsibility cannot lawfully be excluded.
Remote online notarization is available when offered for the requested transaction and permitted by applicable law.
Clients using remote online notarization must satisfy the applicable identity verification, communication technology, document, and recordkeeping requirements. They must also have the necessary device, internet connection, camera, microphone, and identification.
A remote online notarization appointment may be postponed, refused, or terminated if identity verification fails, the technology is inadequate, the signer cannot participate appropriately, the signer does not appear willing or capable of proceeding, or legal requirements cannot be satisfied.
Certain electronic notarizations require an audiovisual recording and other records to be retained for periods prescribed by law. We handle such records in accordance with applicable legal and security requirements.
Remote online notarization is not available for every document or transaction. We do not guarantee that every recipient will accept a remotely notarized document. Clients should confirm any special acceptance requirements with the relevant lender, title company, government agency, attorney, or other recipient before booking.
We respect the privacy of our clients and handle personal information for legitimate business purposes, including scheduling, service delivery, communication, payment processing, recordkeeping, security, and legal compliance.
We do not sell personal information collected through our website or share it with unrelated organizations for their independent marketing purposes.
Limited disclosures may be necessary to deliver requested services, coordinate a signing assignment, work with authorized service providers, comply with legal requirements, or fulfill a client's instructions.
For more information, please review our Privacy Policy on our website.
Clients should use designated secure channels when transmitting sensitive personal, financial, mortgage, or legal documents. General website contact forms should not be used to transmit sensitive information unless specifically authorized.
Noveris Signature may receive assignments through signing companies, lenders, title companies, attorneys, and other business partners. These organizations may establish additional instructions, deadlines, service standards, or payment terms for their assignments.
Where an applicable written agreement governs an assignment, its terms may supplement or control over these general Terms of Service to the extent of any inconsistency.
We are not responsible for independent third-party websites, technology platforms, document preparation systems, payment services, or decisions made by lenders, title companies, or other transaction participants.
To the fullest extent permitted by applicable law, Noveris Signature will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the use of our services, including lost profits, lost business opportunities, transaction delays, or a third party's refusal to accept documents, except where such limitation is prohibited by law.
We do not guarantee that a signing will result in loan approval, loan funding, successful recording, completion of a real estate transaction, or acceptance of documents by any third party.
Nothing in these Terms of Service excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, willful misconduct, or other liability that cannot lawfully be waived.
Nothing in this section removes any non-waivable rights or remedies available to a client under applicable law.
To the extent permitted by law, clients and business partners are responsible for losses, claims, or expenses arising from their own unlawful conduct, materially inaccurate information, failure to provide required documents or instructions, or violation of these Terms of Service.
Nothing in this section requires a client to indemnify Noveris Signature for losses caused by our own negligence, willful misconduct, or other conduct for which indemnification is prohibited by law.
Any indemnification obligation arising under a separate written agreement will be governed by that agreement.
Noveris Signature will not be responsible for delays or inability to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, traffic incidents, road closures, public emergencies, power outages, internet or platform failures, labor disruptions, or government restrictions.
Where reasonably possible, we will notify affected clients and make reasonable efforts to reschedule or provide an alternative arrangement.
This provision does not excuse obligations that cannot lawfully be excused.
Website content, branding, logos, text, graphics, and other materials belonging to Noveris Signature may not be copied, reproduced, distributed, or used commercially without prior written permission, except as permitted by law.
Users agree not to misuse our website, attempt unauthorized access, interfere with its operation, submit fraudulent information, or use the website for unlawful purposes.
We reserve the right to restrict access to the website where reasonably necessary to protect its security, integrity, or lawful operation.
We encourage clients to contact us promptly if they have concerns about an appointment, fee, document handling, or service quality. We will make reasonable efforts to review complaints and resolve issues professionally.
Nothing in these Terms of Service prevents a client from exercising a legal right, filing a complaint with an appropriate regulatory authority, or pursuing a remedy available under applicable law.
These Terms of Service are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any court proceeding relating to these Terms of Service shall be brought in a court with appropriate jurisdiction, subject to applicable law and any valid separate written agreement.
We may update these Terms of Service from time to time to reflect changes in our services, business operations, technology, or legal requirements.
Updated terms will be posted on our website with a revised effective date. The revised terms will apply as permitted by law. Material changes will not retroactively alter rights or obligations where prohibited by law.
If any provision of these Terms of Service is found to be unlawful, invalid, or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.
